Terms of Use

1. Acceptance

These Terms of Use ("Terms") govern your use of Trending Photo Prompt (the "Service"), operated by an independent developer ("we", "us"). By accessing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to use the Service, and at least 18 years old to purchase credits. By using the Service you represent that you meet these requirements and that your use does not violate any law applicable to you.

3. Your Account

You sign in with email or Google through Supabase Auth. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at support@trendingphotoprompt.com if you suspect unauthorized access.

4. The Service

The Service provides AI photo prompt generation and AI image generation. Image generation is delivered by our upstream provider (fal.ai). Prompt suggestions, image quality, generation speed, and availability are provided on an "as-is" basis and may change.

5. Credits and Billing

• One-time purchases. Credit packs are sold as one-time purchases, not subscriptions. You will not be charged again unless you start a new purchase.
• Pricing. Prices are shown in U.S. dollars on the pricing page and at checkout. Final tax, where applicable, is calculated by Creem.
• Payment processor. Payments are processed by Creem as Merchant of Record. By purchasing, you also accept Creem's Buyer Terms.
• Credit grant. Credits are added to your balance after Creem confirms successful payment via webhook. If credits do not appear within 10 minutes, contact support.
• Usage. Each successful image generation consumes one credit. Failed generations are automatically refunded to your balance.
• Expiry. Credits do not expire while your account is active. Unused credits are forfeited if you delete your account or if your account is terminated for a violation of these Terms.
• Non-transferable. Credits have no cash value, cannot be transferred, and cannot be exchanged outside the Service.

6. Refunds

Our refund policy is published at /refunds/. In summary: full refund for unused credits within 14 days of purchase, prorated refunds for partially used credits in that window, and full refunds for duplicate charges or technical failures. Refund requests are reviewed within 3 business days.

7. Acceptable Use

You may not use the Service to create, request, or distribute content that:

• Depicts a real, identifiable person without their explicit consent, including deepfakes, face-swap, and unauthorized likenesses of celebrities, politicians, or other public figures.
• Sexualizes or exploits minors in any way (a strict, zero-tolerance prohibition).
• Is pornographic, sexually explicit, or designed to harass, defame, or threaten others.
• Promotes violence, terrorism, self-harm, illegal drugs, weapons, or hateful conduct toward protected groups.
• Infringes intellectual property rights, including copyrighted characters, logos, or trademarks you do not own or license.
• Generates misinformation or impersonates real organizations, news outlets, or officials.
• Violates any applicable law or regulation in your jurisdiction or in the jurisdiction where the Service is operated.

We use automated screening on submitted prompts and may refuse, remove, or report content that we believe violates this section. Repeated or severe violations result in account termination without refund.

8. Generated Content

Subject to your compliance with these Terms and fal.ai's terms, you own the images you generate through the Service. You are solely responsible for how you use those images, including for any commercial use, and for ensuring you have all rights and consents needed. We may store prompt text and image URLs for fraud prevention and support purposes as described in the Privacy Policy.

9. Third-Party Services

The Service integrates Supabase, Vercel, Creem, fal.ai, and Google sign-in. Your use of those services is also governed by their respective terms and privacy policies. We are not responsible for the actions, outputs, or decisions of third-party providers.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation. AI-generated outputs may be inaccurate, offensive, or unsuitable for your use case; review every output before use.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages. Our aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid to us in the six (6) months preceding the claim, or (b) USD 50.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Service, content you submit or generate, your violation of these Terms, or your violation of any third-party right.

13. Termination

You may stop using the Service and request account deletion at any time by emailing support. We may suspend or terminate your account if you violate these Terms, attempt fraud, or create legal risk for the Service. Sections that by their nature should survive termination (including Sections 8, 10, 11, 12, 14) will survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service shall be finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under its rules in force at the time of submission. The seat of arbitration shall be Hong Kong; the language shall be English. Nothing in this section prevents either party from seeking interim or injunctive relief in a court of competent jurisdiction.

15. Changes

We may update these Terms as the Service evolves. Material changes will be reflected in the "Last updated" date above. Continued use of the Service after changes constitutes acceptance.
